How do you qualify for care under the CCA?
The help you are entitled to will depend on whether you are disabled, elderly, or both. Under the terms of the National Assistance Act 1948, disabled means people who are blind, deaf or dumb, and other people who have been permanently handicapped by illness or injury. It also includes people who were born with a deformity or who are suffering from a mental illness or are partially sighted or hard of hearing.
You or your carer should contact your Local Authority's social services. They will then assess your finances and your health to work out what care services you need.
Your doctor will probably tell you to ask for an assessment as well.
You will normally be given a copy of the assessment of your needs.
If it is clear that you can afford to pay for your own care, your Local Authority may decide not to carry out an assessment. This is because, even if they did, they would not be able to help you financially.
If your Local Authority agrees that you need long term care in a care home, the amount of support they give you will depend on your personal financial situation - a means test is applied.
Your Local Authority may charge you for services other than care home care. This charge will be based partly on the cost of providing the service.
Although Local Authorities have to provide the care you need if you qualify for it, there are times when there are more demands on their budgets than they can meet, and they are unable to provide immediately all the care that is requested at any one time. This means that although the care services will be made available, you may have to wait some time before you start receiving them.
